Modul Pools ("we," "us," or "our") respects your privacy. This Privacy Policy explains what personal information we collect through https://www.modulpools.com (the "Site") and in the course of providing our services, how we use and disclose it, and the rights you have over it. We operate in California, New York, Arizona, and Texas, and this policy describes the rights available to residents of those states under applicable law, including the California Consumer Privacy Act, as amended (the "CCPA"), and the Texas Data Privacy and Security Act (the "TDPSA").
1. Information We Collect
Depending on how you interact with us, we may collect the following categories of personal information:
- Identifiers — name, postal address, email address, phone number, IP address, and online identifiers.
- Customer records — information you provide in forms, such as project details, service address, and contact preferences.
- Commercial information — services inquired about or purchased, quotes requested, and transaction history.
- Internet and network activity — browsing activity on our Site, pages viewed, time on site, referring URLs, and interactions with ads.
- Geolocation data — approximate location derived from your IP address and the service area you identify.
- Inferences — preferences and interests drawn from the above to deliver relevant communications.
We do not intentionally collect sensitive personal information (see "Sensitive Personal Information" below). We also do not knowingly collect personal information from minors under 18 years of age. However, our use of advertising and analytics technologies (such as the Meta Pixel and Google advertising tags) may be considered "selling," "sharing," or processing for "targeted advertising" of identifiers and internet activity under the CCPA and the TDPSA.
You have the right to opt out. To do so, visit our Do Not Sell or Share My Personal Information page. We also honor opt-out preference signals, including the Global Privacy Control (GPC), transmitted by your browser.
In the preceding 12 months, we may have shared or processed for advertising the following categories: identifiers, internet/network activity, and inferences. We do not share sensitive personal information for these purposes, and we do not knowingly sell or share the personal information of consumers under 16.
7. Your Privacy Rights by State
California Residents (CCPA)
If you are a California resident, you have the right to:
- Know / access the categories and specific pieces of personal information we have collected, the sources, the purposes, and the categories of third parties to whom we disclosed it;
- Delete personal information we collected from you, subject to legal exceptions;
- Correct inaccurate personal information;
- Opt out of the sale or sharing of your personal information for cross-context behavioral advertising;
- Limit the use of sensitive personal information beyond permitted purposes;
- Non-discrimination for exercising any of these rights.
Texas Residents (TDPSA)
If you are a Texas resident, you have the right to:
- Confirm and access whether we are processing your personal data and obtain a copy of it;
- Correct inaccuracies in your personal data;
- Delete personal data provided by or obtained about you;
- Obtain a portable copy of the personal data you previously provided, in a usable format;
- Opt out of the sale of personal data, targeted advertising, and profiling in furtherance of decisions that produce legal or similarly significant effects.
Appeals. If we decline to act on your request, you may appeal our decision by contacting us at info@modulpools.com. We will respond to your appeal within the time required by law. If your appeal is denied, you may contact the Texas Attorney General to submit a complaint.
New York, Arizona, and Other States
New York and Arizona do not currently have comprehensive consumer privacy laws that grant statutory access, deletion, or correction rights. Regardless of where you live, however, we make the following choices available to all of our users: you may opt out of advertising-related sale/sharing through our Do Not Sell or Share My Personal Information page or the GPC signal, and you may contact us to request access to or deletion of your personal information, which we will honor to the extent practicable. New York residents are additionally protected by New York's data-security law (the SHIELD Act), and we apply reasonable safeguards to personal information as described under "Data Security." We do not knowingly collect the personal information of minors under 18.
How to Exercise Your Rights
You may submit a request by emailing info@modulpools.com or calling (714) 766-6274. To opt out of sale/sharing or targeted advertising, use our Do Not Sell or Share My Personal Information page. We will verify your identity before fulfilling access, deletion, or correction requests, typically by confirming information already associated with you, and we will respond within the timeframes required by applicable law. You may also designate an authorized agent to make a request on your behalf; we may require proof of authorization and verification of your identity.
8. Sensitive Personal Information
We do not collect or process sensitive personal information (such as government identifiers, precise geolocation, or information revealing health, race, religion, or similar categories) for the purpose of inferring characteristics about you. If our practices change, we will update this policy and provide any required notices and choices.
9. Data Retention
We retain each category of personal information for as long as necessary to fulfill the purposes described in this policy, including to provide services you requested, maintain business records, and comply with legal obligations. Inquiry and lead information is generally retained for 24 months after your last interaction, unless a longer period is required.
10. Data Security
We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information, consistent with applicable state data-security laws. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If a data breach affecting your personal information occurs, we will notify you as required by the applicable state's breach-notification law.
